SUBJECT MATTER AND RULES

The website is a specialized Internet store for the supply and sale of EMF protection products through the Internet by the individual order of a customer. The order is valid only after confirmation by email to the customer. The address of the customer specified in the order form is to be the address of delivery.

PRODUCTS

The products which are for sale on the website are designed in New Zealand and manufactured in China. All products comply with international safety standard and meet strict electromagnetic emission standards. The alleged order for purchase is considered exclusive consent of the customer regarding the quality and appearance of the product.

PERSONAL INFORMATION

When a purchase is made at our store, as part of the buying and selling process, we collect the personal information you give us such as your name, address and email address. When you browse our store, we also automatically receive your computer’s internet protocol (IP) address in order to provide us with information that helps us learn about your browser and operating system. Email marketing: With your permission, we may send you emails about our store, new products and other updates.

TERMINATION

Blushield may terminate the access to the website, without cause or notice, which may result in the forfeiture and destruction of all information associated with its customers. All provisions of these Terms and Conditions that by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

LINKS TO OTHER SITES

The Site may contain links to third-party sites that are not owned or controlled by Blushield. These third party sites have separate and independent privacy policy. The Company therefore has no responsibility or ability for the content and activities of these linked sites.

COOKIE POLICY

In accordance with Directive 2009/136/EC, (the “Cookies Directive”), which amends Directive 2002/58/EC, Blushield guarantees that any cookies used on our website do not contain personally identifiable information about our customers. We use cookies to help identify your computer so we can tailor your user experience, track shopping basket contents and remember where you are in the order process.

LIMITATION OF LIABILITY

In no event shall Blushield, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for damages, direct or consequential, resulting from the customers’ use of the website or the products sold therein, and the customers agree to defend, indemnify and hold Blushield harmless from any claims, losses, liability costs and expenses. These products are not intended to diagnose, cure, or prevent specific diseases or medical conditions. The Blushield website is for education and information purposes only and is not intended as medical advice or a substitute for medical advice. Blushield does not intend these products to cure any physical, skin, or mental conditions solely from their use. A qualified health professional should always be consulted prior to using products, and professional medical attention should be sought with regard to any serious or life-threatening conditions.

WARRANTY DISCLAIMER

The use of the website and the products sold therein is at the customers’ sole risk. The website is provided on an “as is” and “as available” basis. No warranties of any kind are provided on the website, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance. Blushield, its subsidiaries, affiliates, and its licensors do not warrant that 1) the website will function uninterrupted, secure or available at any particular time or location; 2) any errors or defects will be corrected; 3) the website is free of viruses or other harmful components; or 4) the results of using the website and the products sold therein will meet the customers’ expectations.

REFURBISHED UNITS

are sold AS IS. There may be imperfections on packaging, but all units sold as refurbished are in perfect working condition. All sales on refurbished units are final. No refunds or exchanges are permitted. No bundle deals are available for refurbished units. Our One Year Warranty is applied to all refurbished units for manufacturer faults or defect on the date of the sale.

These rules can also be found on the RETURN POLICY page. When placing an order to deliver anywhere outside the United States, you are agreeing to the following terms:

Customs Charges

Duties and taxes (VAT) on the order are not included in the cost when the purchase is made on www.blushield.com. These charges will be payable by the customer upon receipt of the product. Blushield will not be liable for any of these charges, and Blushield will not reimburse the customer for the same.

Duties and taxes (VAT) will not be calculated by Blushield for the customer prior to the order being placed, or afterward.

If the customer refuses to pay these charges upon delivery, and the item gets returned to us, the customer is responsible for the return shipping charges, and will not be refunded for the original delivery charge. Return shipping charges will be deducted out of the cost of refunding the item when it is returned to us.

GOVERNING LAW

These Terms and Conditions (and any further rules, polices, or guidelines incorporated by reference) shall be governed and construed in accordance with the laws of New Zealand, without giving effect to any principles of conflicts of law.

CHANGES TO THESE TERMS AND CONDITIONS

Blushield reserves the right to modify or replace these Terms and Conditions. The customers are considered to be bound by any changes of the Terms and Conditions as of the moment of their publication on the website. Continued use of the website after any such changes constitutes acceptance of the new Terms and Conditions. The customers are advised to review these Terms and Conditions periodically for changes. If they do not agree to any of these Terms and Conditions or any changes to them, they shall not use, access or continue to access the website or shall discontinue any use of the website and products purchased therein immediately.
